General Conditions Escaping NL B.V., Escaping B.V., Escaping BvBa & Escaping GmbH.
 

Article 1 - Definitions

1.1 "Escaping" means the private company Escaping NL B.V., Escaping B.V., Escaping BvBa and/or Escaping GmbH.
1.2 "Customer" means any natural or legal person who has concluded an agreement with Escaping with the purpose to using the facilities of Escaping.
1.3 "Facilities" means all services and products offered by Escaping such as, but not exclusively; escape rooms, meeting facilities, team building activities and catering facilities.
 

Article 2 - Applicability

These terms and conditions apply to any agreement that includes Escaping, as well as any participation in any of Escaping's facilities. These terms prevail over any other set of terms that may be used by any customer unless otherwise agreed.
 

Arikel 3 - Reserve

Booking an escape room is available online or by telephone. From both telephone and online bookings, the customer always receives a booking confirmation by e-mail at the customer's e-mail address.
 

Article 4 - Participants guarantee

For group arrangements a minimum number of participants applies. The minimum number depends on the specific facility that has been agreed. If there are fewer customers than the guarantee amount specified for that specific facility then at least the cost for the minimum number of customers will be charged. The specific warranty numbers and the corresponding amounts
 

Article 5 - Payment

5.1 Payment must be made before using any facility.
5.2 If payment has been agreed upon after invoicing, payment must be made within fourteen (14) days after the invoice date. This term is fatal.
5.3 In case of retrospective payment, Escaping has the right to charge administration fees.
 

Article 6 - Non-payment

6.1 In case of non-payment or non-timely payment in accordance with the deadlines specified above, the customer wil be in default. In that case, the customer who does not act in the exercise of an occupation or company by the due date of the fatal term owes Escaping the legal interest at the time. The customer who acts in pursuit of a profession or company is subject to the current interest rate due on the due date of the fatal term.
6.2 In case of non-payment or non-payment, the customer will pay collection costs. A customer who does not act in the exercise of a profession or company will be liable in accordance with the provisions of the "Besluit voor vergoeding Buitengerechtelijke Incassokosten 2012". A customer who acts in the exercise of a profession or company will be subject to charges in accordance with what is dealt with determined in report "Voorwerk II".
 

Article 7 - Cancellation

7.1 If a customer who does not act in the exercise of a profession or company is not paid in accordance with what has been agreed, Escaping reserves the right to cancel any reservation and to charge the actual cost of the cancellation.
7.2 If a customer who does not act in the exercise of a profession or company is not paid in accordance with what has been agreed, Escaping reserves the right to cancel any reservation and a percentage of the expected turnover due to the relevant reservation including operating fee and VAT to claim, depending on the time of cancellation and ascending up to 100% of the expected sales including operating fee and VAT.
7.3 If a customer decides to terminate the use of any facility prematurely, no refund will be granted.
7.4 What is stated in this article does not apply when a customer cancels the reservation 48 hours or earlier prior to the resume of the reservation through the cancellation link contained in the confirmation email of the reservation.
7.5 If the customer who does not act in the exercise of an occupation or company canceled its booking within 48 hours prior to the time of the booked activity, but no later than two hours before commencement of the activity, Escaping is entitled to charge 25 euro cancellation fee.
7.6 If the buyer is not present five minutes prior to the location of the customer-reserved facilities and without prior notice, Escaping is entitled to qualify for such absenteeism as a cancellation.
7.7 Escaping reserves the right to cancel and / or change reservations without any form of compensation without notice. Or refuse specific visitors when Escaping sees it.
 

Article 8 - Safety

8.1 Access to the facilities of Escaping and the surrounding area is at your own risk.
8.2 When entering the unit, one is consciously aware of an environment where there is an increased risk of injury or injury. Escaping applies strict rules to ensure the safety of everyone.
8.3 Upon entering the whole, you accept an increased risk and you agree to the applicable safety regulations. These rules are displayed in various places, are available free of charge at each registration desk and are listed on the Escaping website.
8.4 The consequences of non-compliance or non-compliance with any safety regulations are for your own account and risk.
8.5 Everyone is obliged to follow Escaping's instructions at any time.
 

Article 9 - Liability Escaping

9.1 Any liability of Escaping for damage (including as a result of theft) of any customers or visitors is excluded, unless mandatory by law.
9.2 The foregoing applies to everyone and regardless of whether the damage is caused by (but not limited to):
- entering escape rooms;
- an accident during the visit to the escape rooms or any accident with another customer (s);
- Violation of safety regulations by any customer or visitor;
- circumstances attributable to the buyer or visitor
9.3 Should Escaping prove to be liable, then that liability is limited to the amount paid under the liability insurance in the particular case.
 

Article 10 - Liability of the buyer

10.1 Customers (and others accompanying them) are jointly and severally liable for damage resulting from loss, theft, or damage to the property or property of (staff of) Escaping and third parties, as well as for any injury caused to employees of Escaping and third parties, regardless of whether the damage or injury is the result of any act or omission of the buyer himself or others who were in agreement with the buyer in the area of ​​Escaping.
10.2 The Buyer indemnifies Escaping for all claims relating to third party damages which are (partly) the result of any act or omission of the buyer, or others who were in agreement with the buyer in the area of ​​Escaping.
 

Article 11 - Complaints

11.1 Despite all the concerns of Escaping, a customer may have a legitimate complaint. This complaint must in principle be reported on-site and directly at the registration desk.
11.2 If a direct notification can not reasonably be expected, the complaint must be submitted to Escaping at least eight working days after receipt of the services or the related invoices, stating the facts on which the complaint relates.
 

Article 12- Applicable law, competent law

12.1 All agreements concluded with Escaping are governed by Dutch law.
12.2 In respect of all disputes arising from this agreement, the court of dismissal of Escaping shall have jurisdiction unless otherwise required by law.
